Purpose
These Terms & Conditions define the conditions under which BELLA YACHT provides yacht charter advisory, yacht selection, booking coordination, destination advice and related services through the website www.bellayachtcharter.com.
Nature of the Service
BELLA YACHT provides a bespoke yacht charter advisory service.
Services may include:
- yacht selection according to the client’s profile, destination, dates and budget;
- availability checks with yacht owners, central agents or yacht managers;
- charter proposal preparation;
- destination and itinerary recommendations;
- coordination of booking steps;
- assistance with charter contracts and payment process;
- optional coordination of additional services such as transfers, catering preferences, water toys, events or concierge requests.
BELLA YACHT acts as an intermediary and advisor. The final charter contract is generally concluded between the client and the yacht owner, yacht manager, central agent or charter operator, depending on the yacht and contractual structure.
Yacht Information, Prices and Availability
All yacht descriptions, images, specifications, crew details, prices, availability, itineraries and services displayed on the website or communicated by BELLA YACHT are provided for information purposes only.
Availability and prices must always be confirmed in writing before any booking.
Charter prices may vary depending on:
- season;
- yacht availability;
- charter duration;
- destination;
- embarkation and disembarkation ports;
- VAT and local taxes;
- APA or running costs;
- fuel consumption;
- port fees;
- delivery or redelivery fees;
- crew expenses;
- additional services requested by the client;
- currency exchange rates where applicable.
Booking Process
A yacht charter is not confirmed by sending a website form, WhatsApp message, email inquiry or verbal request.
A booking becomes effective only when:
- the yacht availability has been confirmed;
- the applicable charter contract has been issued and signed;
- the required deposit or payment has been received;
- all relevant booking conditions have been accepted by the parties.
BELLA YACHT may assist the client throughout this process but cannot guarantee the final availability of a yacht until formal confirmation by the yacht owner, manager, central agent or operator.
Online Booking, Payment and Electronic Signature
Where the website offers online booking, payment, deposit payment, contract signature or electronic confirmation features, such actions remain subject to the specific terms of the applicable yacht charter proposal, charter agreement, payment provider and electronic signature process.
A booking is only confirmed once all required steps have been completed, including, where applicable:
- written confirmation of yacht availability;
- acceptance of the applicable charter terms;
- signature of the relevant contract or booking document;
- receipt of the required payment, deposit or balance;
- validation by the yacht owner, central agent, yacht manager or charter operator.
BELLA YACHT may use third-party providers for online payment, electronic signature, booking management, client information forms and contract handling.
The client is responsible for checking all booking details before validating any payment or electronic signature.
Electronic signatures, online confirmations and digital records may be used as proof of acceptance, subject to applicable law.
Charter Contracts
Depending on the yacht, destination and operator, the charter may be governed by a specific charter agreement, including but not limited to MYBA, CYBA, local charter contracts, operator contracts or owner-specific terms.
The applicable charter contract shall prevail over these general website terms in case of contradiction regarding the charter itself, including cancellation, payment schedule, liabilities, insurance, navigation area, APA, VAT and operational conditions.
Payments
Payment terms are defined in the charter proposal, invoice and/or applicable charter contract.
Payments may include, depending on the charter:
- booking deposit;
- balance payment;
- APA or advance provisioning allowance;
- VAT or local taxes;
- delivery/redelivery fees;
- security deposit;
- optional services;
- concierge or third-party service fees.
Unless otherwise agreed in writing, the booking is not confirmed until the required payment has been received.
Cancellation
Cancellation terms depend on the yacht, destination, operator and applicable charter contract.
Any cancellation request must be made in writing.
Cancellation fees may apply according to the signed charter contract, third-party supplier conditions or expenses already incurred.
BELLA YACHT shall not be responsible for cancellation fees imposed by yacht owners, central agents, yacht managers, captains, operators or third-party service providers.
Weather, Safety and Itinerary Changes
The captain remains solely responsible for the safety of the yacht, guests and crew.
The planned itinerary may be modified due to weather conditions, safety requirements, port restrictions, technical reasons, administrative decisions or force majeure events.
BELLA YACHT cannot guarantee a specific route, anchorage, navigation plan, beach club, restaurant booking or destination access when such elements depend on weather, safety, port authorities, captain’s decision or third-party availability.
Third-Party Services
BELLA YACHT may coordinate or recommend third-party services such as transfers, restaurants, private chefs, water toys, event services, berth reservations, security, concierge services or other yacht-related services.
These services are provided by independent third parties.
BELLA YACHT is not responsible for the performance, delay, cancellation, fault or negligence of third-party providers unless a fault directly attributable to BELLA YACHT is proven.
Client Responsibilities
The client agrees to provide accurate information regarding:
- preferred dates;
- destination;
- number of guests;
- budget;
- special requirements;
- passport or identity information where required;
- dietary preferences;
- medical or safety-relevant information where necessary;
- payment and billing details.
The client must comply with the yacht’s rules, captain’s instructions, safety requirements, local laws and charter contract terms.
Liability
BELLA YACHT is bound by a best-efforts obligation in the performance of its advisory and coordination services.
BELLA YACHT maintains professional indemnity insurance with ITIC — International Transport Intermediaries Club. Any liability of BELLA YACHT remains subject to applicable law, the signed contractual documents and the terms, limits and exclusions of the relevant insurance policy.
BELLA YACHT does not guarantee:
- yacht availability before formal confirmation;
- completion of a booking before signature and payment;
- weather conditions;
- sea conditions;
- access to specific destinations;
- performance of third-party providers;
- absence of technical issues on board;
- decisions made by captains, owners, operators, ports or authorities.
BELLA YACHT shall not be liable for indirect damages, loss of enjoyment, loss of opportunity, financial loss, travel disruption or any damage resulting from events outside its direct control.
Force Majeure
BELLA YACHT shall not be held liable for any failure or delay caused by events beyond its reasonable control, including but not limited to adverse weather, natural disasters, pandemics, strikes, port closures, administrative restrictions, war, civil unrest, technical breakdowns, transport disruption, government decisions or force majeure events.
Consumer Mediation
BELLA YACHT is in the process of appointing a consumer mediator in accordance with Articles L.612-1 and following of the French Consumer Code.
The name and contact details of the appointed consumer mediator will be published on this page and in the Terms & Conditions as soon as the appointment is confirmed.

Personal data collected through the website is processed according to the Privacy Policy available on the website.
Governing Law and Jurisdiction
These Terms & Conditions are governed by French law.
In the event of a dispute, the parties shall first attempt to resolve the matter amicably.
Failing amicable resolution, the dispute shall be submitted to the competent courts in accordance with applicable law.
